Consumer Terms of Sale

These Consumer Terms of Sale apply to purchases made through this website by private individuals acting for personal use. If you are buying for business purposes, trade or resale, separate trade terms may apply.

Nothing in these terms limits or excludes any rights you have under applicable consumer law.

1. About Us

Your contract for goods purchased through this website is with Genpower Ltd.

2. Placing an Order

When you place an order through this website, you are making an offer to purchase the goods selected.

After you place your order, we will send you an acknowledgement email confirming that we have received it. This acknowledgement does not mean that your order has been accepted.

Your order is accepted, and a binding contract is formed, only when we send you a dispatch confirmation email confirming that the goods have been dispatched.

We reserve the right to refuse or cancel an order before dispatch where reasonably necessary, including where goods are unavailable, there is a pricing or description error, payment cannot be authorised, or we reasonably suspect fraud or misuse.

If we cancel an order after payment has been taken, we will refund you in full.

3. Product Information

We try to ensure that all product descriptions, images, specifications and prices are accurate. However, images are for illustration only, and colours, packaging, branding details and minor specifications may vary.

If we discover an error in the price or description of goods you have ordered, we will contact you as soon as reasonably possible and give you the option to proceed on the correct basis or cancel your order for a full refund.

4. Prices and Payment

All prices shown on this website are in pounds sterling and include VAT where applicable unless otherwise stated.

Delivery charges and any additional charges will be shown clearly before you place your order.

We may offer payment by debit card, credit card, BACS, Klarna, Clearpay, Tower Finance or other payment methods displayed at checkout.

Payment must be received in full before goods are dispatched unless a different arrangement is clearly stated at checkout.

Payments made by card are processed securely by our payment providers. If you choose to use a third-party payment service, your use of that service will also be subject to that provider’s own terms and privacy policy.

5. Delivery

Delivery options, estimated delivery times, cut-off times, postcode restrictions, charges and any exclusions will be shown at checkout and on our Delivery Information page.

Any delivery dates or times are estimates unless we have expressly agreed otherwise in writing.

Unless a longer period is expressly agreed, we will deliver goods without undue delay and in any event within 30 days of the date the contract is formed.

If your order contains multiple items, we may deliver them separately where reasonable.

Risk in the goods passes to you when the goods are delivered to the delivery address you provided. Ownership of the goods passes to you once we have received payment in full.

6. Right to Cancel

If you are a consumer, you usually have the legal right to cancel your order within 14 days of receiving the goods, without giving any reason, subject to any exceptions that apply by law.

To cancel, you must tell us clearly by email, post or another written method before the cancellation period expires.

You must send the goods back to us without undue delay and no later than 14 days after telling us you wish to cancel.

We will refund the price paid for the goods and the standard outbound delivery cost within 14 days of receiving the returned goods back, or receiving evidence that you have sent them back, whichever is earlier. We may reduce the refund to reflect any loss in value caused by handling beyond what is necessary to inspect the goods.

7. Returns Policy

In addition to your legal cancellation rights, we may offer a goodwill returns period as described on our Returns Policy page.

Any goodwill returns policy is in addition to, and does not replace, your statutory rights.

8. Faulty, Damaged or Incorrect Goods

Please inspect your order as soon as reasonably possible after delivery and contact us promptly if goods are missing, incorrect, damaged or faulty.

We may ask you for photographs or other reasonable information to help us investigate transit damage or product faults.

Nothing in these terms removes or reduces your statutory rights in relation to goods that are faulty, damaged, not as described or not fit for purpose. We may encourage prompt reporting of transit damage, but failure to notify us within 24 or 48 hours does not remove any rights you may have under consumer law.

9. Warranty

Some goods may come with a manufacturer’s warranty or guarantee. Details of any applicable warranty will be provided on the relevant product page or with the goods.

Any manufacturer’s warranty is in addition to, and does not affect, your legal rights as a consumer.

10. Liability

We are responsible for foreseeable loss or damage you suffer if it is caused by our breach of these terms or our negligence.

We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any breach of your statutory consumer rights.

We supply goods for domestic and private use. If you use goods for any commercial, business or resale purpose, we will not be liable for any loss of profit, loss of business, business interruption or loss of business opportunity, except where such exclusion is not permitted by law.

11. Complaints

If you have any complaint about goods purchased from us, please contact our customer service team using the contact details shown on our website. We will try to resolve complaints fairly and promptly.

12. Governing Law

These Consumer Terms of Sale are governed by the law of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your home jurisdiction.
